Napolitano is being disengenuous - he knows very well the Constitution does not spell out *how* the Congress must declare war and that international law plays a role here in determining whether military law is applicable or not. He also knows Ex Parte Quirin, Eisentrager and Hamdan precedents on tribunals/commissions.
